Judge Recommends Ruling for City in Median Case. U.S. Magistrate Judge Renee Harris Toliver recommended against an injunction that would prevent Dallas from enforcing its ban on activities on road medians. The injunction was part of a lawsuit filed against the city by four individuals (including two unhoused people). Toliver also disagreed with the lawsuit’s assertion that the city’s ban was unconstitutional, saying that the ban on standing or walking on medians less than 6 feet wide was too “narrowly tailored” to violate the First Amendment. Her recommendation will go to U.S. District Judge Ada Brown for a final ruling.

Among the high points? Homicides have slowed since May (they’re still up 10 percent so far this year) and violent crime is down 11 percent.

In a video clip shared Tuesday, Dallas-based Todd Interests gave a glimpse into the first phase of construction at the now-shuttered Fairfield Lake State Park. The company bought the 5,0000 acres to build a luxury development and country club in June from Vistra, who had leased the property to the state at no cost for about 50 years. On June 10, the Texas Parks and Wildlife Commission voted to use condemnation to take the property through eminent domain.
