Main Witness Against Mark Cuban Testifies In SEC Trial. If I’m reading this correctly, and I like to think that I am, Mamma.com CEO Guy Fauré testified via video deposition because he’s Canadian and can’t be compelled to testify in person at the trial, and his recollection of their conversation and subsequent events (“Mark, I have confidential information”; some “not impolite yelling” happens; Cuban: “Well, now I’m screwed, I can’t sell”; Cuban sells anyway) would be written out of a movie about this case because it was a little too convenient. I mean, I don’t think Cuban would let this go to trial if that is actually literally how it went down, unless he believes in the time-honored maxim that “no American jury will ever believe a Canadian, especially if his name is Guy and even more especially if it’s pronounced to rhyme with ‘Key’ and his company is named — are you kidding me with this? — Mamma.com.” I think Mark Twain first said that.

Family Wants Charge of Attempted Murder Against Man Who Shot 8-Year-Old Boy In The Face. Brian Cloninger is in jail on a charge of felony injury to a child after shooting D.J. Maiden in the face on September 3. Cloninger wants his bond reduced and has a hearing to that effect next week. Maiden’s family wants him to be charged with attempted murder. The DA’s office says, however, that injury to a child is actually the tougher charge despite the connotation of “attempted murder” — first-degree vs. second-degree felony — and has a sentence of 5 to 99 years or life in prison rather than 2 to 20. Maiden may never regain feeling in his jaw and tells his grandmother that he looks like a monster, so I’m OK with whatever keeps Cloninger behind bars the longest.
