I love this. The Fifth Circuit has upheld the dismissal of former Police Chief Terrell Bolton’s wrongful termination suit against the City of Dallas because “it should not be held responsible if the city manager failed to follow procedure when he fired Bolton…” Ted Benavides, the city manager in question, hired Bolton without interviewing him, so it is no surprise he fired him in the same slapdash way. And because Benavides was just as incompetent in his firing as he was in his hiring, the suit is dismissed. It strikes me as a novel defense, but it worked. (Oh, how I miss those days!)
