Thumbs Down to the 5th U.S. Circuit Court of Appeals for refusing citizenship to British national Richard John Longstaff of Dallas because he didn’t declare that he was a homosexual 19 years ago when he first entered the United States and to the U.S. Supreme Court for refusing to hear the case. When Longstaff, who owns Union Jack clothing stores in Dallas and Houston, applied for citizenship in 1974, it was denied. After a 10-year battle to gain citizenship, he realized that his case was being used to test a federal law that denies citizenship to “psy-chopathic personalities,” which in 1965 was altered to include homosexuals. Because “the law is on the books,” Dallas Immigra-cion and Naturalization Service official <B>Ron Chandler threatened to deport Longstaff earlier this year. Longstaff has moved to San Francisco to seek protection from the 9th U.S. Circuit Court of Appeals, which currently holds that he cannot be deported.
