A jurist of sound judgment and moderate philosophy, Higginbotham’s opinions have tended to be subtle, wise and even-handed. He’ll be a needed antidote to the out-of-date liberalism of the 5th Circuit’s William Wayne Justice, who’s toyed disastrously with a number of Texas institutions, from elections to the prison system.
