You’ve got one smart cookie for an attorney. on Dec 1 new Federal rules of civil procedure went into effect. the key points concerned electronic evidence and the preservation of such.

Basically your attorney put the offenders on notice that they may be sued. That notice forces the alleged offenders to preserve any and all information that may be relevant to the case. If they did destroy the material relevant then they faced spoliation of evidence.

Which can result in the other side losing the case as a judge can instruct a jury to consider them guilty because they destroyed evidence.
