What is most shocking about the issue is that Carruthers is not an American citizen, but is rather a Scot holding a united Kingdom passport. Accordingly, the U.S. government has decided to criminalize behavior in cyberspace committed by foreign nationals — corporations and their principals — that is otherwise perfectly legal in the nation where such foreign nationals claim residence (such as Britain). From a constitutional law standpoint, this story is going to be a big one.
